"My wax girl is ghosting me and owes me money"

Pictures give most of the context, but I'll include dates. Mid-November is when I bought myself and my sister wax packages totaling $460. In mid- December I used 1/10 of my waxes from the package. After that, I had planned to go back to get waxed in early January. It is now May.

I've looked on her Instagram page, Groupon page, and website to see her refund policy (spoiler: there is no refund policy). More information to know, she mentioned a health problem she has in passing to me during one of the waxes, which is why she is taking time off. I am a healthcare worker and I am empathetic to health issues that cause people to take a break. I'm just not a fan of the way she's gone about this.

As someone who had been her loyal client for over 2 years, I expected better business practices than taking my money and obviously spending it without rendering the services. If she had given me a refund, I would have come back to her once she got better. But she has not communicated with me even when I feel like I'm asking perry simple questions.

I filed a claim with my bank and with Venmo, the app we had been using for our wax transactions. Both could not help me and told me to make it work with the seller. She always asked us to make payments on Venmo with a heart emoji instead of the actual service, but because the service was so expensive I made sure to label those two specifically. Problem is, I didn't know there was a difference between "Goods and Services"

and "Friends and Family" transactions, so I had been using the latter. I feel like the next step is small claims court. WWYD?

I hope your health returns completely and that you feel better soon. I will be praying. I am bummed I will not be able to have you as my waxing girl anymore and that my sister won't be able to meet you. I know we bought packages from you, let me know what to do for refund stuff. Love you feel better

Hey I'm just reaching out as it's now February. I know you're closing up shop and that likely has taken up a lot of your time, and I'm sensitive to your health situation. I was wondering how you will be going about refunding for the two packages I bought (the 10-wax Brazilian package for $390 and the Self-Care package I bought my sister for $70). I did use 1/10 of the waxes from the package I bought from you, so the total refund should be $421. ($390- $39 +$70) I don't want to burden you with th

Hi love thank you so much! I'm doing okay I am sorry for such a delay in responding I have been juggling moving and drs appointments. In a month or two I will be starting up again part time just a day or so a week. I will definitely let you know when I do. All packages are nonrefundable however they never expire so once I return you will still have your credits and your sister will still have her services available i will truly miss our appointments

Tue, Feb 4 at 7:01 AM I understand why large packages like this normally must be non- refundable, but I'm not comfortable with not knowing when my next appointment is with you or if you will even open shop in the future. It would be different if I randomly wanted money back.. but you said you were closing up shop so that's more long term and undefined in terms of duration, and I understand why it has to be that way.

It's honestly just a lot of money to be holding, 9 more months worth of waxes that I won't know when I can redeem, and a package for my sister that I'm not sure will ever be redeemed as she's new and has no rapport with you. It's a lot of uncertainty. I'm just not comfortable with that. Just being transparent with you about my feelings on this. Sorry. Wed, Feb 5 at 11:28 AM I completely understand however the packages are all non refundable I do assure you that you will have all remaining credit

Okay, I understand. I'll see you when you're better, hopefully soon! Let me know if you need anything. Sun, Mar 2 at 9:23 PM Hey girl just checking in as it's been a month, any good updates on your health? I also remember you saying you may be opening up shop this month for a day or so a week, is that still happening?

Sat, Apr 19 at 10:40 AM Hey girl, checking in again. It's been almost 5 months since your initial message and even longer since I've seen you in person. I hope things are going well and was wanting to know if you had a back-in-service update. Today 10:02 AM Hey I'm so sorry to do this but I feel like I'm being ghosted and I don't know if you're ever coming back to be an esthetician. I paid

you for two packages and it's been almost 6 months since I've expected to receive them. I again would like to ask for a refund. I know it might be financially tough but you've put me in a weird situation as a loyal client. I've been in other situations where a business owner had to step away from their business for personal reasons, but they never made me wait on them like this. In fact they just refunded me and we kept good rapport. This is a really uncomfortable and unfortunate situation and I

The advice from commenters was largely the same: sue her!

rachh90 just sue her in small claims. pretty slam dunk case. non refundable doesnt mean what she thinks it means.

RedS010Cup Hey girl! Go to small claims court - these people aren't your friends and not sure if you've convinced yourself of that due to the highly personal type of work this is. If this were any other business, you wouldn't be casually texting back and forth and letting this person run all over you.

hotwaterwithlemo... This is the easiest small claims case in the world, sue her.

Equizotic I used to run a small business that offered horseback riding lessons in packages. When I had to close up to move, I either refunded everyone or if they wanted - fit all of their lessons into the weeks I had left. It was a busy time but worth it to please my clients even if I wasn't coming back to the area ever again. This is just bad business here.

Level-Juggernaut... The text messages should also count as evidence. You should definitely continue pursuing this in court. Also in the future, never hand someone that much money upfront unless they're a real company with a location and phone number.

MKVIgti Small claims court. I personally DON'T know why packages like this could be "non refundable." And I don't think she understands the terms of those one bit. Small claims will be your best bet. You'd probably easily win and I doubt she'd even show up.
